These Terms of Service (“Terms”) govern your use of Kapsule Cloud services provided by Kapsule Group Limited (“Kapsule”, “we”, “us”, “our”). By using our services you agree to these Terms.
1. Services
Kapsule Cloud provides cloud hosting, virtual private servers, managed WordPress hosting, domain registration, and email hosting services. Service specifications are described in the applicable product pages and your account portal. We reserve the right to modify, suspend, or discontinue any service with reasonable notice.
2. Acceptable use
You may not use our services for any unlawful purpose, to distribute malware, to send unsolicited bulk email (spam), to host content that infringes intellectual property rights, or to conduct denial-of-service attacks. We reserve the right to suspend or terminate services that violate this policy without refund.
3. Payment and billing
Services are billed monthly or annually in advance in New Zealand Dollars (NZD). Prices shown are exclusive of GST. We issue compliant NZ tax invoices. Overdue invoices may result in service suspension after 7 days notice.
4. Refund policy
We offer a 14-day money-back guarantee on new accounts. Refund requests must be submitted within 14 days of the initial payment. Refunds are not available for domain registrations, which are non-refundable once registered with the registry.
5. Uptime and SLA
We target 99.9% monthly uptime for all services. Scheduled maintenance windows will be communicated at least 24 hours in advance. Service credits for downtime below our SLA are available — contact support with details of the outage.
6. Data and backups
While we perform regular automated backups, you are responsible for maintaining your own backups of critical data. Our backups are provided as a convenience and are not a substitute for your own backup strategy.
7. Privacy
Our collection and use of personal information is governed by our Privacy Policy. We comply with the New Zealand Privacy Act 2020.
8. Limitation of liability
To the extent permitted by law, Kapsule's total liability to you in connection with our services is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential loss or damage.
9. Governing law
These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
10. Changes to these terms
We may update these Terms from time to time. We will notify you by email of material changes at least 30 days before they take effect. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
